GENERAL TERMS AND CONDITIONS

1. GENERAL:
1.1 These terms and conditions are applicable to all offers, orders and agreements with Bijou Gio Design (hereafter Seller). 
1.2 Deviations of these terms and conditions are only allowed after a written agreement with Seller.
1.3. Both Seller and Buyer acknowledge electronic communication and will not deny the validity thereof.



2. PRICES:
2.1 All jewellery prices on the website of Bijou Gio Design are mentioned in EURO and are inclusive of VAT and inclusive of registered mail (Track & Trace) in the European Union. 
2.2 For countries outside of the European Union, an extra amount for postal charges will be charged for the registered mail (Track & Trace) through UPS or DHL. 
2.3 All prices are subject to changes. Changed prices do not influence the running orders.
2.4 If it turns out that a faulty price is mentioned in an order, the customer will be informed of this. No rights can be derived from this.



3. ORDERS:
3.1 Ordering goes through the website of Bijou Gio Design(www.bijougiodesign.eu, www.bijougiodesign.nl, www.bijougiodesign.it) through the therefore destined electronic order form. 
3.2 The electronic order form needs to be filled out completely and according to the truth.
3.3 By sending in the electronic order form, you agree with the general terms and conditions of Bijou Gio Design.
3.4 As soon as your order has been finalised online, there is an agreement.
3.5 An agreement will only come into being after acceptance of your order by Bijou Gio Design.  Bijou Gio Design is authorised to reject orders.
3.6 If an order is not accepted, you will be notified within three days. If you already have made a payment, this amount will be refunded to you fully.



4. PAYMENT:
4.1 Delivery will only be made after advance payment.
4.2 Payments will be made through the website of Bijou Gio Design, through an SSL secured Payment Server Provider. 
4.3 Up until the amount due has been received, the products will remain in the possession of Bijou Gio Design. 
4.4 The delivery lead-time starts from the moment at which Bijou Gio Design has received payment. 
4.5 You will receive an e-mail when your order has been shipped.



5. SHIPMENT & DELIVERY LEAD TIME:
5.1 Bijou Gio Design does not process orders on Sundays, national holidays and during closing periods for the holidays. 
5.2 Orders placed on the abovementioned days will be processed the next workday. 
5.3 In principle, the ordered products will be shipped as soon as possible, provided that they are in stock. 
5.4 If an ordered product is out of stock, we will inform you within three working days per e-mail about the current production and delivery lead time. The ordered products should be delivered at the Buyer’s within a maximum of 30 days after the order has been placed, unless the Seller and Buyer have agreed otherwise. 
5.5 If any ordered products are out of stock, and are no longer available, we will offer you an alternative, or you can request a refund. 
5.6 The delivery lead-time for products in stock is between three to ten workdays in the Netherlands.
5.7 For delivery of products in stock outside of the Netherlands and within the European Union, the delivery lead-time is approximately five to ten workdays. 
5.8 For countries outside of the European Union, the delivery lead-time for products in stock is approximately five to fifteen workdays. Import duties must be paid by Buyer. 
5.9 The ordered products will be shipped through registered mail with track and trace, autograph required for delivery, and insurance.
5.10 If the ordered products cannot be delivered by the transportation company on the delivery address you provided and need to be returned to Bijou Gio Design, the Buyer will be charged for the total amount of shipping costs.
 
6. TERM OF APPROVAL & RETURNS:
If the product you bought does not meet your expectations, you can return it following the below mentioned conditions:
6.1 Return within seven days after the receipt of the product.
The postal stamp is in this case decisive for returning the product.
6.2 All returns need to be registered through e-mail at order@bijougiodesign.eu at least three days in advance. 
6.3 Special and differing made-to-measure products ordered by the Buyer cannot be returned. 
6.4 Returned products will only be accepted in undamaged condition, unworn, and in the original packing with the original bubble foil, along with the invoice. 
6.5 Any damages to returned articles will be charged to the Buyer. 
6.6 All return shipments should be stamped sufficiently. In case of insufficient stamp, the Buyer will be charged. 
6.7 The return shipment is fully the responsibility of the Buyer, until it has reached our office. 
6.8 No refund will be given on shipping costs.
6.9 Shipping costs are inclusive of: registered mail, insurance, autograph for receipt and any necessary import or export documents. 
6.10 The shipping costs will be deducted from the order amount. In the Netherlands, the shipping costs per order are 10 euros. For countries within the European Union, shipping costs are 20 euros, for countries outside of the European Union, shipping costs are 50 euros. 
6.11 The refund of the total amount, minus the shipping costs, will be paid within fourteen days after you received a confirmation of receipt per e-mail.

7. MAINTENANCE & SERVICE:
By maintaining our bijou in the right way, and cleaning it regularly, you will be able to enjoy it longer. If you maintain the bijou regularly, the right way, and live up to the below mentioned regulations, you will be able to enjoy our bijou for years.
7.1 To prevent colouring etc., please clean and maintain our bijou with the product spray ‘Razzle Dazzle’ (spray lightly and carefully rub dry with a soft cloth). This product can be obtained through the website of Bijou Gio Design and the website of Razzle Dazzle, or at quality jewellers in the Netherlands.
7.2 Water (salt), bleach, aggressive detergents, and other chemicals will permanently damage your jewellery; this will not be covered by the warranty.
7.3 It is best to store the bijou immediately after wearing it in the supplied luxurious jewellery box of Bijou Gio Design. Please make sure the box is closed. 
7.4 Please handle the bijou, and the vulnerable crystals in it, with care. 
7.5 If service maintenance on your jewellery is needed after the warranty period, please get in touch with us. 
7.6. Bijou Gio Design repairs her own sold jewellery at a small cost, in order for you to be able to wear them again. The shipment costs will be charged to the Buyer.
 
8. WARRANTY & LIABILITY:
Bijou Gio Design offers quality products, made-to-measure. Every design is unique and handmade. Small deviations can occur, because they are all unique handmade designs. 
8.1 The warranty term on construction errors in the design is three months after the purchase, and only with invoice and when the piece is bought directly through Bijou Gio Design. 
8.2 You need to inform Bijou Gio Design in writing in advance, before returning the product. 
8.3 The return shipment is fully the responsibility of the Buyer, until it has reached our office. 
8.4 The repair period of Bijou Gio Design is approximately three weeks.
8.5 All costs for repair or replacement of a product within three months after the purchase will be paid for by Bijou Gio Design, inclusive of the shipment costs to the Buyer. 
8.6 If the product shows construction errors during this warranty period that are made by Bijou Gio Design and appear to be irreparable, you will receive a coupon for an equal product in the shape of a voucher that can be exchanged within six months through the electronic order form on the website of Bijou Gio Design. The flaw needs to be determined by Bijou Gio Design. No rights can be derived from this.
8.7 The warranty term is not applicable if the flaw is caused by incorrect and/or intentional crude use, normal wearing out, and colouring of the jewellery because of incorrect maintenance. 
8.8 If, after returning, it shows that the flaw is caused by incorrect and/or intentional crude use, the warranty term will be cancelled. In this case, we will inform you via e-mail. If the product can be repaired, you can decide to use our repair service. The costs for the reparation, inclusive of shipping costs, will be charged to the Buyer. The damaged or repaired product will be delivered after advance payment has been made to Bijou Gio Design.
8.9 Bijou Gio Design is not liable for any damages after the delivery of the ordered products, for example allergies, any direct or indirect damages, to you or your family members, your goods, third parties or goods of third parties.
 
9. FORCE MAJEURE:
9.1 In case of force majeure, any flaw that cannot be imputed to Bijou Gio Design, because it is not due to faults by Bijou Gio Design, nor by virtue of the law.
9.2 In case of force majeure, Bijou Gio Design reserves the right to terminate the agreement without legal intervention by informing the Buyer of this in writing or through e-mail. 
9.3 Bijou Gio Design is not obliged to pay any damages, unless it, given the circumstances and according to the criterion of reasonability and fairness would not be acceptable.
 
10. DATA MANAGEMENT & PRIVACY:
The information you provide Bijou Gio Design with will only be used for our own administration. 
10.1 The information will be used to keep you informed of your order, to contact you about your order, and for sending your order. 
10.2 The information can be used for sending our newsletter, discount promotions, personal vouchers and invitations for jewellery parties and exhibitions to your e-mail address. If you do not appreciate this, please send us an e-mail with ‘unsubscribe’ in the subject line.
 
11. COMPLAINTS:
If you have any complaints or are not satisfied with certain things, please contact us through e-mail.



12. DEVIATIONS:
12.1 All images and information regarding all offered articles will be shown as exact as possible. 
12.2 Deviations in texts, colours, prices and images reserved.
 
13. OTHER:
If one or more of the conditions in these terms and conditions, or in any other agreement with Bijou Gio Design are in violation of any applicable law, the concerning condition will be cancelled, and it will be replaced by another lawful condition, which will be determined by Bijou Gio Design.



14. APPLICABLE LAW & COMPETENT COURT:
14.1 Only Dutch law is applicable to all rights, obligations, offers, orders, and agreement on which these terms and conditions apply, including these terms and conditions. 
14.2 All disputes that have risen between Bijou Gio Design and Buyer will be presented to a competent Dutch court. 
14.3 If a Buyer holds Bijou Gio Design legally responsible, this should at all times be in the Netherlands.
 
15. COPYRIGHT & TRADEMARK RIGHTS:
15.1 Bijou Gio Design is a registered trademark. It is prohibited to reproduce, multiply, and sell the jewellery designs of Bijou Gio Design, without prior written consent of Bijou Gio Design. 
15.2 All texts and images on this website of Bijou Gio Design are protected by copyrights, including the web design of Bijou Gio Design. It is prohibited to copy, publish, multiply, or use texts, images, and web design in any way, without our prior written consent.
